Thanks to James Stark of Garden Court North Chambers for allowing us to provide a link to this paper he has written about the subject of Public Law in Public Spaces and especially about Public Spaces Protection Orders. This paper was first presented at the Public Law Project’s Manchester annual conference in a session entitled ‘Public Law in Public Spaces’.
To date we have come across one case where a Local Authority have used a PSPO to ban unauthorised encampments of Gypsies and Travellers on certain areas of land and another case where a Local Authority are thinking of banning unlawful moorings in their area. We believe that Public Spaces Protection Orders are highly challengeable and would be very interested to hear from anyone affected by them.
