Peace Emezie -v- Secretary of State for the Home Department [2013] EWCA Civ 733 26 June 2013
This is not a Gypsy or Traveller case but it is an important reminder on the question of costs in judicial review cases.
The Claimant’s case was settled upon the Defendant supplying her with suitable alternative accommodation. Suitable alternative accommodation had been requested in pre-action correspondence. In such circumstances, the Court of Appeal conformed, the Claimant’s costs should be paid by the Defendant.
